This policy sets what is and is not allowed on ResellerBytes hosting, including fair-usage limits.
1. Why this policy exists
Most ResellerBytes hosting runs on shared servers and a shared network. One account sending spam, hosting malware or using far more than its share of resources can slow down or blacklist sites belonging to other customers. This Acceptable Use Policy ("AUP") sets out what isn't allowed, so the Services stay secure and usable for everyone.
This AUP is part of our Terms of Service. It applies to every service and account, to resellers and their end users, and to anyone who uses the Services through your account. You're responsible for what happens on your account, including on sites you host for others.
2. Illegal and harmful content
You may not use the Services to store, publish, send or link to content that:
- is illegal under the laws applicable to Diligent Creators Pvt. Ltd. or in the place where it's accessed, or that facilitates illegal activity;
- sexually exploits or endangers children. We report such material to the relevant authorities;
- infringes copyright, trademarks or other intellectual property rights, including pirated software, media or license keys;
- is fraudulent or deceptive, including phishing pages, fake shops, scam investment schemes and impersonation of other people or businesses;
- contains or distributes malware, viruses, ransomware or other harmful code;
- threatens, harasses or incites violence against people or groups;
- publishes other people's private information without permission (doxxing).
Some kinds of content are legal but can still put the server, our network or other customers at risk. If you're unsure whether a site is allowed, ask us in a support ticket before you put it online.
3. Email and spam
You may not:
- send unsolicited bulk or commercial email (spam), or send to purchased, rented or scraped lists;
- send mail that hides or forges its sender, headers or origin;
- run open mail relays or open proxies;
- advertise a site hosted with us in spam sent from any network;
- exceed the email sending limits that apply to your plan or account.
Bulk mail you send must go only to people who have opted in, and every message must include a working unsubscribe link. Persistent high bounce rates or spam complaints may lead to sending being paused while we investigate.
4. Network and security abuse
You may not use the Services to:
- attack, probe, scan or test the vulnerability of any system or network without the owner's permission;
- launch or take part in denial-of-service attacks;
- gain or attempt to gain unauthorized access to any account, system or data, including other customers' accounts on our servers;
- intercept or monitor traffic that isn't yours;
- run botnet controllers, command-and-control servers or brute-force tools;
- get around resource limits, security controls or account restrictions.
5. Resource usage and fair usage
Shared hosting accounts share CPU, memory, disk activity and processes with other accounts on the same server. To keep performance fair:
- Each account must stay within the resource limits that apply to its plan.
- Where a plan feature is described as "unlimited" or "fair usage" (for example, storage, bandwidth or email accounts), it's intended for the normal operation of the websites on that account. It isn't for file storage, backups of other systems or media distribution unrelated to your sites. If an account's usage affects other customers, we'll contact you to discuss options, such as reducing usage or moving to a larger plan.
- You may not run processes that place a sustained heavy load on the server, such as cryptocurrency mining, game servers, persistent background daemons or large-scale crawling.
- Hosting accounts may not be used mainly as file storage, backup storage or a content mirror.
If an account regularly exceeds its limits, we'll contact you and may recommend an upgrade. If the usage affects other customers, we may limit or temporarily suspend the account first to protect the server, then contact you.
6. Your security responsibilities
You must take reasonable steps to keep your account and sites secure, including:
- using strong, unique passwords and turning on two-factor authentication where available;
- keeping CMS software, themes, plugins and scripts up to date;
- removing unused software and accounts;
- dealing promptly with any compromise we tell you about.
If your site is compromised and starts sending spam or hosting malware, we may suspend it until it's cleaned, even though you didn't intend the abuse.
7. Resellers
If you resell our Services, you must make sure your end users follow this AUP. You must respond to abuse reports we forward about your end users within the time we set in the notice.
8. Reporting abuse
To report spam, phishing, malware, copyright infringement or other abuse involving a site or service hosted with ResellerBytes, email support@resellerbytes.com with "Abuse report" in the subject line. Please include the URLs, email headers or other evidence, and your contact details.
Copyright complaints should identify the work, the infringing material and your authority to act for the rights holder. Send them to support@resellerbytes.com.
9. How we enforce this policy
When we find or are told about a breach, we may, depending on how serious it is:
- contact you and ask you to fix it within a set time;
- remove or disable access to the specific content involved;
- limit resources or pause email sending;
- suspend the affected service or account;
- terminate the service or account.
We'll normally contact you before acting. We may act immediately, without notice, where the breach is serious, is causing harm to other customers or third parties, or where we're legally required to. Services suspended or terminated for breaching this AUP aren't eligible for a refund, as set out in our Refund Policy.
We cooperate with law enforcement and may share information with them where the law requires it or where we believe it's needed to prevent harm, in line with our Privacy Policy.
10. Changes to this policy
We may update this AUP to deal with new types of abuse or changes to our Services. We'll post the updated version here with a new effective date and notify you of material changes by email or in the client area.
