These terms apply to every ResellerBytes service. The Acceptable Use, Privacy, Refund and Domain Registration policies sit alongside them.
1. About these terms
These Terms of Service ("Terms") are an agreement between you and Diligent Creators Pvt. Ltd. ResellerBytes is a service brand of Diligent Creators Pvt. Ltd. ("ResellerBytes", "we", "us" or "our"). They apply when you create an account, order a service or use our website at resellerbytes.com and our client area.
By creating an account or placing an order, you agree to these Terms and to the policies they refer to:
- Acceptable Use Policy
- Privacy Policy
- Refund Policy
- Domain Registration Terms, if you register, renew or transfer a domain with us
If you're accepting these Terms on behalf of a business, you confirm that you have authority to bind that business, and "you" means that business.
2. Definitions
- Services: the hosting, domain, email, SSL and other products you order from us, as described on our website and in your order.
- Client area: the online account area at portal.resellerbytes.com where you manage services, invoices and support tickets.
- Customer content: the files, data, websites, email and other material you or your users store on or send through the Services.

3. Your account
3.1 You must be at least the age of legal majority where you live to open an account.
3.2 You must give accurate, complete and current information when you sign up and keep it up to date, including your email address. We send important notices, invoices and renewal reminders to that address.
3.3 You're responsible for keeping your login details secure and for all activity under your account. Tell us promptly if you believe your account has been accessed without permission.
3.4 We may ask you to verify your identity or payment details before we activate a service or make changes to your account. We may decline or cancel an order that we can't verify or that we reasonably believe is fraudulent.
4. Orders and provisioning
4.1 An order is accepted when we activate the service, not when you submit it.
4.2 Service features, resource limits and inclusions are those shown on the plan page at the time of your order. We may update plan features for new orders. If we materially reduce a feature of a service you already have, we'll tell you in advance.
4.3 Some features depend on third parties, such as domain registries, certificate authorities and software vendors. Their availability may change outside our control.
5. Prices, billing and renewals
5.1 Prices are shown on our website and in the client area in US dollars. The price you pay is the one shown at checkout.
5.2 Prices exclude taxes unless stated otherwise. You're responsible for any applicable taxes, duties or bank charges.
5.3 Services are billed in advance for the billing cycle you choose. Services renew automatically at the end of each cycle at the renewal price then in effect unless you cancel before the renewal date.
5.4 We issue a renewal invoice before each due date and send it to your account email address. If you've saved a payment method that supports automatic charges, you authorize us to charge it for renewal invoices on or after the due date.
5.5 Renewal prices may differ from introductory or first-term prices. Domain renewal prices are listed on our domain pricing page. We'll give you notice before a price increase applies to your renewal.
5.6 Accepted payment methods are shown at checkout and in the client area.
6. Late payment, suspension and termination for non-payment
6.1 If an invoice isn't paid by its due date, we may suspend the related service after the due date has passed.
6.2 If the invoice remains unpaid after suspension, we may terminate the service and delete its data, including customer content. We aren't obliged to keep backups of terminated services.
6.3 Domains that aren't renewed by their expiry date are handled under the Domain Registration Terms.
7. Canceling a service
7.1 You can cancel a service at any time by submitting a cancellation request from the client area or by opening a support ticket. Unless agreed otherwise, cancellation takes effect at the end of the current billing cycle.
7.2 When a hosting service ends, its customer content will be deleted. Download anything you want to keep before the cancellation date.
7.3 Canceling a service does not by itself entitle you to a refund. Refunds are covered by the Refund Policy.
8. Acceptable use and fair usage
8.1 You must use the Services in line with the Acceptable Use Policy and applicable law.
8.2 Shared hosting resources are shared with other customers. Where a plan is described as "unlimited" or "fair usage", it is subject to the resource limits in the Acceptable Use Policy.
8.3 If your use of a service harms the server, our network or other customers, we may limit, suspend or move the service. Where practical, we'll contact you first and give you a chance to fix the issue.
9. Your content and responsibilities
9.1 You keep all rights to your customer content. You give us the limited permission we need to store, copy, transmit and back up that content to provide the Services.
9.2 You're responsible for your customer content and for making sure you have the right to use it, including any software, images or data you upload.
9.3 You're responsible for keeping the software you install up to date, such as WordPress, themes and plugins, and for securing your own websites and applications.
9.4 Backups. Some plans include backups, as described on the plan page. Any backups we take are provided for convenience and don't replace your own backups. You should keep current copies of your customer content.
10. Resellers
10.1 If you're a reseller, you're responsible for your end users and their use of the Services, including their compliance with these Terms and the Acceptable Use Policy.
10.2 You must have your own terms with your end users that are at least as protective of us as these Terms. You handle your end users' billing and first-line support. We provide support to you, not directly to your end users, unless agreed otherwise.
10.3 If an end user breaches these Terms, we may act against the affected service, and we'll tell you when practical.
11. Domains
Domain registrations, renewals and transfers are also subject to the Domain Registration Terms, the registrar's agreement and the policies of the relevant registry and ICANN. If these Terms and the Domain Registration Terms conflict on a domain matter, the Domain Registration Terms apply.
12. Service availability and maintenance
12.1 We work to keep the Services available, but we don't guarantee they will be uninterrupted or error-free.
12.2 We may carry out scheduled maintenance. Where we can, we tell customers about planned maintenance in advance through our service announcements, linked from our system status page. Emergency maintenance may happen without notice.
13. Support
We provide support through support tickets and by email at support@resellerbytes.com, as described on our Contact Support page. The level of support depends on your plan. Support covers our Services. It doesn't extend to third-party software, custom code or website design unless stated in your plan.
14. Security and account access
14.1 We may access your account and customer content when it's needed to provide support you've asked for, maintain the Services, investigate a breach of these Terms or comply with the law.
14.2 If we believe your account has been compromised, or is being used to attack others, we may suspend affected services to contain the problem and will tell you as soon as practical.
15. Third-party software and services
Some Services include or rely on third-party software (for example, hosting control panels, software installers or SSL certificates). Your use of that software may be subject to the third party's license terms. We aren't responsible for third-party software or services we don't control.
16. Intellectual property
The ResellerBytes name, logo, website and client area are owned by us or our licensors. These Terms don't give you any rights in them except as needed to use the Services.
17. Privacy
We handle personal information as described in our Privacy Policy.
18. Suspension and termination by us
18.1 We may suspend or terminate a service, or your account, if:
- you materially breach these Terms or the Acceptable Use Policy;
- we're required to by law, a court, a regulator or a domain registry;
- your use poses a security risk or causes harm to our systems, other customers or third parties; or
- you provided false information or the order appears fraudulent.
18.2 Where reasonable, we'll give you notice and an opportunity to fix the problem first. We may act without notice where the risk or legal requirement makes that necessary.
18.3 Services terminated for a breach of these Terms or the Acceptable Use Policy aren't eligible for a refund. Some services, including domain registrations, are never refundable, as set out in the Refund Policy.
18.4 We may stop offering a service with reasonable notice to affected customers.
19. Disclaimers
Except as expressly stated in these Terms, the Services are provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.
20. Limitation of liability
20.1 To the extent permitted by law, we aren't liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, business, data or goodwill.
20.2 Our total liability arising from or relating to these Terms or the Services is limited to the amount you paid us for the affected service in the 12 months before the claim arose.
20.3 Nothing in these Terms limits liability that can't be limited under applicable law.
21. Indemnity
You agree to indemnify us against claims, losses and costs (including reasonable legal fees) arising from your customer content, your use of the Services in breach of these Terms or applicable law, or, if you're a reseller, your end users' use of the Services.
22. Force majeure
We aren't responsible for failure or delay caused by events beyond our reasonable control, including natural disasters, power or network failures outside our network, actions of governments or registries, and large-scale cyber attacks.
23. Changes to these Terms
We may update these Terms from time to time. We'll post the new version on this page with a new effective date and, for material changes, notify you by email or in the client area a reasonable time before they take effect. If you continue to use the Services after that date, the updated Terms apply. If you don't agree, you can cancel affected services before the change takes effect.
24. Governing law and disputes
24.1 These Terms are governed by the laws applicable to Diligent Creators Pvt. Ltd.
24.2 Before starting formal proceedings, please contact us so we can try to resolve the issue. Open a support ticket or email support@resellerbytes.com and describe the dispute.
24.3 Subject to 24.2, the competent courts having jurisdiction over Diligent Creators Pvt. Ltd. have jurisdiction over disputes arising from these Terms. Nothing in these Terms removes any rights you have under the mandatory consumer laws of the country where you live.
